Terms of use and sale
Last updated: [EFFECTIVE DATE]
In short: scanning and previewing are free. A paid recovery costs £19, $19 or €19 once and covers one drive. Paddle.com sells it to you. An account is optional. Recovery depends on the state of the drive, so we cannot promise every file will come back; that is why you see your files before you pay. If the files you recover do not open, you can have your money back within 30 days. Restore with AI, which repairs photos with an AI model, is optional and paid for with credits; credits you have not used can be refunded within 14 days of buying them. Your legal rights as a consumer are not affected.
1. Who we are
Data Recovery Pro is made by Bonny James, trading as Data Recovery Pro ("we", "us"), [POSTAL ADDRESS]. We are not registered for VAT; Paddle, which sells the app to you, charges and pays any VAT due. You can contact us at [CONTACT EMAIL] or through the support page.
2. What these terms cover
These terms apply when you use this website, the Data Recovery Pro app, an optional account, our support tickets and our live chat. They work together with:
- the software licence, which sets out how you may use the app;
- the acceptable use policy;
- the refund policy;
- the privacy notice and cookie notice, which explain how we handle personal data.
If these terms and the software licence disagree about the app, the software licence applies.
3. Who sells it to you: Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you pay, you buy from Paddle, and Paddle's buyer terms apply to the purchase. Paddle takes your payment, charges any VAT or sales tax, issues your invoice and processes refunds. These terms cover your use of the software and our services.
4. What is free and what you pay for
- Downloading Data Recovery Pro, scanning a drive and previewing what it finds are free.
- You can recover the first 10 files or 100 MB from a drive free.
- A paid recovery costs £19, $19 or €19 (VAT or sales tax included where it applies), paid once. It unlocks every file Data Recovery Pro finds on one drive, plus free re-scans of that same drive for 7 days from purchase. It is not a subscription.
- The purchase is tied to the drive by its volume serial number, through a signed receipt that the app checks on your computer. A different drive needs its own purchase. If the drive is reformatted, its volume serial number may change and the receipt may no longer match it.
- Restore with AI is optional and uses credits. One credit restores one photo. Credits are sold in packs, for a single payment each: Starter (25 credits) £3.99, Family (100) £9.99, Archive (500) £29.99 and Studio (2,000) £79.00, or the same number in US dollars or euros, VAT or sales tax included where it applies. Credits are not a subscription.
- Each paid recovery comes with 5 free credits. Free credits have no cash value.
- Credits do not expire. They belong to the copy of the app they were bought in, or to your account once you sign in from the app. They cannot be exchanged for money, except under the refund terms in section 9 and the refund policy, or transferred to another person.
- The other Enhance tools (sharpen and upscale, colour and brightness, crop) run on your computer and are free.
- The price you pay is the price shown at checkout. Paddle may show it in your local currency.
5. Accounts are optional
You never need an account to scan, preview, pay or recover. If you create one, you can see your purchases, download invoices, restore receipts to the app, and follow your support tickets.
- You sign in with a 6-digit code we email to you, or with Sign in with Apple or Google if you choose. Keep access to your email account secure: anyone who can read your email can sign in.
- Purchases made with the same email address as your account are linked to it automatically.
- Give us an email address you control, and keep it up to date in your account.
- One person per account. Do not sign in as someone else.
- You can export your data or delete your account at any time from your account page. Deleting it removes your login, tickets and messages. We keep purchase records for tax and accounting law, unlinked from you; see the privacy notice. Any credits on your account are lost when you delete it: they do not return to the app and cannot be refunded afterwards.
- We may suspend or close an account that breaks the acceptable use policy. Closing an account does not take away recoveries you have paid for; the receipts work offline in the app.
6. Support and live chat
You can ask for help through a support ticket, by email or, where available, through live chat. We aim to reply within 2 working days; this is an aim, not a guarantee. Please:
- never send us your recovered files or other private files. We do not need them to help you;
- be honest and courteous, and do not use support or chat to send spam, abuse, or illegal content.
Support is advice on using Data Recovery Pro. It is not a professional data recovery service, and we cannot inspect or repair your drive.
7. You must have the right to recover the drive
Only use Data Recovery Pro on drives that you own, or that the owner has allowed you to recover. A second-hand card or a drive belonging to someone else may contain their personal data, and recovering it without permission may be unlawful. You are responsible for how you use recovered files. See the acceptable use policy.
8. What the software does, and its limits
- It runs on macOS 13 or later and on Windows 10 (22H2) and Windows 11, 64-bit (the Windows version is in early access). It reads the drive read-only and saves recovered files to your computer or another drive, never to the drive being scanned.
- It reads file tables on FAT16, FAT32 and exFAT drives, and runs a signature deep scan on any drive. Version 1 does not scan the computer's internal drive.
- Recovery depends on what has happened to the drive. Files that have been overwritten cannot be recovered, and we do not promise that any particular file, or any file at all, will come back. That is why you can scan and preview before paying.
- Each file is labelled intact, partly damaged or not checked before you pay. A file is only labelled intact once it has actually been decoded. Recovery itself does not repair damaged files. The optional Enhance tools save changed copies as new files and never alter the recovered files.
- Restore with AI sends each photo you choose, through our server, to an AI model run by a third-party provider (see the sub-processors page), which returns a redrawn version. The result is generated by AI: faces, text and fine detail may differ from the original, and any part it fills in is invented, not recovered. We do not promise any particular result. The app marks these files AI-redrawn.
- Only send photos you have the right to use, and nothing unlawful. The AI provider may refuse some images. A restore that fails or is refused, or that you stop before it finishes, returns its credit to your balance automatically.
- It is not suitable for physically failing drives (clicking, not spinning, repeatedly disconnecting). Use a professional recovery lab for those.
9. Your right to cancel (UK and EU consumers)
If you are a consumer in the UK or EU you normally have 14 days to cancel a purchase of digital content. Because the paid recovery starts immediately, the checkout asks you to agree that supply begins straight away and to acknowledge that you then lose that right to cancel. If you do not agree, you cannot complete the purchase. Our money-back promise in section 10 applies on top of this.
Credits for Restore with AI are digital content too, but supply of each credit begins only when you use it. You can cancel a credit pack within 14 days of buying it and get a refund for the credits in it that you have not used. When you start a restore, you ask us to supply it straight away, and you lose the right to cancel for each credit that is used. Free credits that come with a paid recovery cannot be refunded. Details are in the refund policy.
10. Money back if the files do not open
If the files you recovered after paying do not open, ask for a refund within 30 days of purchase and you will get your money back through Paddle. You can ask through the support page, from your account, or at paddle.net. Details are in our refund policy. This promise covers paid recoveries; refunds of credits are covered in section 9.
11. Your legal rights
Nothing in these terms affects your statutory rights. Under the Consumer Rights Act 2015, digital content must be as described, of satisfactory quality and fit for purpose. If it is not, you are entitled to a repair or replacement, or in some cases a full or partial refund. For more information, contact Citizens Advice.
12. Our liability to you
Data recovery always carries some risk. A drive that is already failing can fail further while it is read, and data that was lost or overwritten before you used the software may be gone for good. So:
- We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable.
- We are not responsible for data that was already lost, overwritten or damaged before you used the software, or for files that cannot be recovered.
- If you use the app for business, we are not liable for loss of profit, business, revenue or business opportunity, and our total liability to you is limited to the amount you paid for the recovery or credit pack in question.
- If digital content we supply damages a device or other digital content you own because we did not use reasonable care and skill, we will either repair the damage or compensate you.
- We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breaking your statutory rights as a consumer.
Keep a copy of anything important. Recovered files are saved to the destination you choose, and we recommend checking them before you erase or reuse the drive.
13. The website
We work to keep the website and our services available, but we do not promise that they will always be available or free of errors. We may change or withdraw parts of the website. The app keeps working offline for recoveries you have already paid for. Restore with AI needs our server and the AI provider, which may sometimes be unavailable; your credits stay on your balance until it works again.
14. Updates and changes to these terms
We may release updates that fix problems or change features; see the software licence. We may update these terms. The version on this page, with its date, applies to purchases made after that date. If a change materially affects an account holder, we will tell you by email before it takes effect.
15. Ending these terms
You can stop using Data Recovery Pro and delete your account at any time. We may suspend access to an account, support or chat if you seriously or repeatedly break these terms. This does not affect refunds or rights you already have.
16. Other terms
- You may not transfer your rights under these terms to someone else without our agreement. We may transfer ours to another business if it does not reduce your rights.
- If a court finds part of these terms unlawful, the rest still applies.
- Nobody else has rights under these terms, except Paddle as set out in section 3.
- If we do not enforce a right straight away, we can still enforce it later.
17. Law and disputes
These terms are governed by the law of [England and Wales — CONFIRM]. If you are a consumer, you can bring a claim in the courts of the part of the UK where you live, and you keep any mandatory protections of the country where you live. Please contact us first so we can try to put things right.
18. Contact
Questions about the software, your account or a recovery: the support page or [CONTACT EMAIL]. Questions about a payment, invoice or refund: Paddle, at paddle.net, or us and we will pass it on.
